Applicants With Criminal Conviction History
The existence of a criminal record does not constitute an automatic bar to employment, with the exception of certain sex or drug offenses specifically prescribed by the California Education Code. In addition, Palomar College will consider qualified applicants with a criminal history pursuant to the California Fair Chance Act. In the case of drug convictions, further consideration is given to personal rehabilitation efforts, as well as a certificate of rehabilitation and pardon. You do not need to disclose your criminal history or participate in a background check until a conditional job offer is made to you. When selected for hire, data regarding criminal conviction history will be collected, and you will be required to undergo Live Scan fingerprinting for purposes of obtaining your criminal conviction history from the California Department of Justice. After making a conditional offer and running a background check, if Palomar College is concerned about a conviction that is directly related to the job, you will be given the chance to explain the circumstances surrounding the conviction, provide mitigating evidence, or challenge the accuracy of the background report. Your Live Scan results and data you provide regarding your conviction history will be kept separate and confidential from your application materials and other documents on file in Human Resource Services. It will not be seen by anyone outside of Human Resource Services. For more information, review Administrative Procedure 7127 Restrictions Governing the Employment of Applicants with Criminal Records. To find out more about the Fair Chance Act, visit the Civil Right’s Department Fair Chance Act webpage.
