What is the Clery Act?
The Jeanne
Clery Disclosure of Campus Policy and Campus Crime
Statistics Act is the landmark federal law,
originally known as the Campus Security Act, that
requires colleges and universities throughout the
United States to disclose information about crime
on and around their respective campus. Because
the law is directly tied to participation in
federal student financial aid programs, it applies
to most institutions of higher education, both
public and private. The act is enforced by the
U.S. Department of Education. The
"Clery Act" is named in memory of 19
year-old Lehigh University freshman Jeanne Ann
Clery, who was raped and murdered on April 5, 1986
while asleep in her residence hall room. Jeanne's
parents, Connie and Howard discovered that
students hadn't been told about 38 violent crimes
on the Lehigh campus in the three years before
Jeanne's murder. They joined with other campus
crime victims and persuaded Congress to enact this
law, which was originally known as the "Crime
Awareness and Campus Security Act of
1990." The
law was emended in 1992 to add a requirement that
schools afford the victims of campus sexual
assault certain basic rights. It was amended again
in 1998 to expand the reporting requirements. The
1998 amendments also formally named the law in
memory of Jeanne Clery. The
law was most recently amended in 2000 to require
schools, beginning in 2003, to notify the campus
community of where the public "Megan's
Law" information regarding registered sex
offenders on campus could be obtained. The

for Reporting the Annual Disclosure of Crime
Statistics The
Campus Police Department prepares the Annual
Disclosure of Crime Statistics in compliance with
the Jeanne Clery Disclosure of Campus Security
Police and Crime Statistics Act at defined in
Volume 20, United States Code 1092. The full text

The report
is prepared in cooperation with local law
enforcement agencies within the communities
surrounding the main campus and specified
alternate sites. Campus crime, arrest and referral
statistics include those reported to the Campus
Police. Campus Security Authorities, and local law
enforcement. The statistical data may include
crime events that have occurred in private
residence(s) or business(es) wherein the reporting
of such data is not required by law. California
Penal Code 11160 requires that health care
practitioners (including persons working in the
Palomar College Student Health Services Office)
must promptly report to law enforcement any care
rendered to a person wherein the caregiver
determines that the injury is caused by a firearm,
abuse or assault. The Palomar College
Department of Counseling Services provides clients
with the necessary information and resources to
voluntarily report any crime(s) to the campus
police should it be determined to be in the best
interest of the client. The Palomar College Police
Department maintains an internal process whereby
any confidential information gathered during such an event
is anonymous. Each year, an email notification is
sent to all enrolled students, faculty, and staff
providing the website address to access the
report. Copies of the report may be obtained by
visiting the Campus Police Department located at
the Main Campus in San Marcos. Campus
Police Authority and Jurisdiction The
Palomar College Campus Police have complete police
authority to apprehend and arrest any person
involved in illegal activity in areas on and
immediately adjacent the campus as per California
Penal Code Section 830.32. All officers
undergo continuous skills refresher and
advancement training. As first responders, all
officers are CPR and First Aid trained and
certified. Officers
are responsible for reporting and investigating
crimes and traffic accidents, responding go
medical emergencies, enforcement of state and
local laws & ordinances, and all other
incidents requiring police assistance. Minor
offenses committed by a student involving college
regulations, policies or rules may also be
referred to the Director
of Student Affairs for initial or
additional enforcement action. Concurrent
Jurisdiction and Part I Crimes
Jurisdiction
is shared with local law enforcement agencies. The
county Sheriff's Department has concurrent
jurisdiction on all campus' and upon all
properties owned and/or controlled by the Palomar
Community College District within the county. For
any campus located within an incorporated city or
municipality, concurrent jurisdiction is shared
with the local police department.
Part I
crimes, such as rape, murder, aggravated assault,
robbery and arson are reported to the
jurisdictional law enforcement authority for the
corresponding area. For serious Felony crimes, a
joint investigative effort is coordinated between
the Campus Police Department and the respective adjacent
law enforcement agency (i.e. Escondido Police, San
Diego Sheriff, etc.). The prosecution of all
felony and/or misdemeanor offenses is conducted
through the San
Diego County District Attorney's Office. Communications The
Palomar College Police Department works closely
and cooperatively with local, state and federal
law enforcement agencies and is a participant in
the Regional Communications System for Mutual Aid.
By a mutual agreement with state and federal
agencies, the Campus Police Department maintains
access to the California Law Enforcement
Telecommunications System, allowing extended
access to the National Law Enforcement
Telecommunications Network. These networked
databases provide access to nationwide historical
criminal data, police records, driver/vehicle
identification information and other local, state
and federal law enforcement information. Safety
on Campus The
Palomar College Police Department promotes Safety
on Campus as one of it's principal goals. In

Palomar College Campus Police Officers at the
specific sites listed. The Palomar College Police
Department maintains contact with local police
agencies in all areas listed & security forces
are in effect during class hours. Security issues
at these locations will be addressed by local
security force(s), campus police or the local law
enforcement agency having jurisdiction (as
necessary).
Prompt
Reporting of All Criminal Incidents & Medical
Emergencies
Any
potential criminal actions, and any emergency
(including medical and fire emergencies) should be
reported directly to the Campus Police by dialing
2289 from any campus phone, any of the blue
courtesy phones located throughout campus, or by
calling 744-1150 x 2289 from any cellular or pay
phone. Campus elevators and a majority of
classrooms are also equipped with emergency
phones. Once a call is received Campus Police
Officers are dispatched immediately and have
authority to make arrests if necessary.
Reporting
Criminal Offenses to the Campus Police
Faculty,
staff and students are encouraged to report any
campus environment criminal or safety issues
directly to the Campus Police. Reports may also be
made to designated Campus Security Authorities
including, but not limited, to:
To report
criminal activity anonymously, call Crime Stoppers
at (888) 580-8477 (TIPS).
The Campus
Police and the Office of Student Affairs will
include confidential and anonymous reports in the
annual statistical report. It is the goal of the
Campus Police to provide assistance when and where
a report is made to ensure inclusion of the
crime data in any annual reporting.
Escorts
Safety
Escort service is available from 7:00 A.M. to
11:00 P.M. for additional safety for persons
transiting the campus alone. Escort service may be
requested by calling via any of the campus blue
"Courtesy" phones, dialing 2289 from any
campus phone or by calling (760) 744-1150, ext.
2289 from any cell phone or payphone.
Timely
Warning Policy
In the
event that a situation arises on or off campus
that, in the judgment of the Palomar College
Campus Chief of Police, constitutes an an ongoing
and/or continuing threat, a campus-wide
"timely warning" will be issued.
Warnings will be issued via the college email
system to students, staff, faculty and the student
newspaper, the Telescope.
Timely
Warning messages may also be posted on the Campus
Police Website URL located at "http://www.palomar.edu/police/timelywarn.htm"
based on specific circumstances of the ongoing
situation. The Campus Police website is available
from any computer, PDA or internet accessible
device with a viable connection to the
internet.
Security
and Access to Campus Buildings
Most
campus facilities are are open to the public
during the day and evening hours during class
session(s). During hours that the campus is
closed, buildings are generally locked. Access to
campus buildings after hours is limited to
approved faculty, staff and specified students
with valid I.D. Most campus buildings are secured
and monitored by security alarms and should only
be accessed during operating hours when alarms are
deactivated. Campus Police Officers or local law
enforcement authorities will respond to any
triggered security alarms and will secure all
buildings and detain any persons triggering such
alarms.
The Campus
Facilities Department maintains the safety and
security aspect of all campus buildings. The
Facilities Department will address all reports of
potential safety or security hazards, including
broken windows, lighting problems, etc. The
Department also conducts a bi-annual review of all
windows, doors, lighting and grounds
maintenance. Building keys are issued to
specific staff members on an access-need basis.
Lost keys must be reported immediately to the
Campus Police Department, wherein a report is
taken before the re-issuance of any keys. Keys
shall not be loaned to any person other than the
key-holder.
Security
Awareness
During the
academic year the Campus Police, Student Health
Services and various other campus organizations
and departments will periodically present Campus
Watch, alcohol, drug, sexual assault and security
awareness presentations and events. These may
coincide with health or safety fairs, or may be
presented ad hoc through interactive
presentations. All crime awareness and crime
prevention programs share a common theme;
"That students and employees are encouraged
to be aware of their personal responsibility for
the security and safety of themselves and that of
others."
Information
is also disseminated to students and employees via
Campus Watch brochures, domestic violence
pamphlets, static displays, PowerPoint ©
presentations, and articles & advertisements
in the student newspaper. When time is of the
essence, security information is released via the
Timely Warning process and is distributed by email
& flyers posted throughout the campus.
Crime
Prevention
A number
of campus organizations sponsor annual personal
safety and theft prevention Crime Prevention
Programs. Campus Police personnel facilitate
programs for students, parents, faculty and
student organizations, providing a myriad of
educational strategies for the implementation of
personal protection initiatives for sexual
assault, theft and other crimes. For more

Crime
Prevention Tip: To enhance your personal safety,
walk with friends or someone from your class that
you are familiar with (especially at night), or
call the Campus Police for a Safety Escort at
(760) 744-1150, extension 2289.
Alcohol
and Drug Policy
It is the
policy of the Palomar Community College District
to provide, maintain, encourage, and support a
drug and alcohol-free campus. The District is
committed to providing a workplace and learning
environment that is alcohol and drug free. The
commitment to this policy is demonstrated through
education, prevention, rehabilitation, and
recovery. An alcohol and drug free campus will
promote the safety and health of students,
employees and the public.
All
employees and students are clearly and expressly
prohibited from the possession, consumption, or
under the influence of alcohol on district
property, or at any district facility (owned,
leased or otherwise held or managed by the
district), and any location where students
students are engaged in a school related activity.
Possession and/or consumption of alcohol by any
employee during the course of work or when acting
within the "scope of employment," is
strictly prohibited.
Scope of
Employment shall be construed as any time of employment,
not to include an employees presence as a
voluntary social activity at a location not
considered a work-place in the course of any
conference, workshop, seminar or similar event
wherein attendance by the employee is approved by
the district.
All
employees and students are clearly and expressly
prohibited from the manufacture, distribution,
dispensation, possession, or use of illegal drugs,
controlled substances, or illegally obtained
prescription drugs on campus, at any school sponsored
event, or while acting within the scope of
employment. The terms "illegal drugs"
and "controlled substances" include all
chemical substances or drugs defined in any
applicable laws, statutes, or regulations; e.g.
the Federal Controlled Substances Act of 1988,
California Health and Safety Code section(s)
11054-11058.
Any
employee or student may possess and use any
prescribed drugs provided the prescription is for
the specified possessor, and that use is
consistent with any doctors instructions, and that
such use does not impair the performance of any
employee or the class-activity of any
student.
While the
district treats violations of the Drug and Alcohol
Policy as serious offenses, with punishment that
may include disciplinary action, expulsion and/or
termination, the first concern of the district is
for the health and safety of the employees and
students. The district is committed to creating
and promoting an environment that reinforces
healthy, responsible living and respect for
community and district standards. This is enhanced
through individual responsibility and the intellectual,
social, emotional, ethical, and physical well-being
of the employees and students of the campus
community.
As a
result, in the event of a violation and prior to
any disciplinary action(s), the district will
attempt to reasonably accommodate any employee or
student with an alcohol or drug related dependency
or problem, and will encourage and assist the
employee or student to seek and obtain appropriate
treatment for the dependency. While the district
realizes the importance of work collectively with
employees and students, unsatisfactory performance
by employees or inappropriate behavior by students
will not be tolerated.
Student
Conduct
Students
attending Palomar College are responsible for
regulating their own personal conduct and to
respect the rights and privileges of others.
Students are expected to conduct themselves in a
manner compatible with the mission of an
educational institution, to respect and obey any
and all civil and criminal laws, and to abide by
the Palomar College Rules and Regulations for
Student Behavior. Failure to abide and comply with
any code, law, statute, rule or regulation is
cause for disciplinary action, which could result
in suspension or expulsion.

local, state and federal civil and criminal

Sex Offender Information (PC 290.01) California
Penal Code Section 290.01 (a)(1): Every person
required to register under section 290 who is
enrolled as a student of any university, college,
community college, or other institution of higher
learning, or is, with or without compensation, a
full-time or part-time employee of that
university, college, community college, or other
institution of higher learning, or is carrying on
a vocation at the university, college, community
college, or other institution of higher learning,
for more than 14 days, or for an aggregate period
exceeding 30 days in a calendar year, shall, in
addition to the registration required by section
290, register with the Campus Police Department
within five working days of commencing enrollment
or employment at that university, college,
community college, or other institution of higher
learning, on a form as may be required by the
Department of Justice. The terms "employed or
carries on vocation" include employment
whether or not financially compensated,
volunteered, or performed for government or
educational benefit. The registrant shall also
notify the Campus Police Department within five
working days of ceasing to be enrolled or
employed, or ceasing to carry on a vocation, at
the university, college, community college, or
other institution of higher learning. For
