BYLAWS, POLICIES and PROCEDURES of the ASSOCIATED STUDENT GOVERNMENT and the ASSOCIATED STUDENT ORGANIZATION of PALOMAR COLLEGE Newly Revised Effective 2006 BYLAWS ARTICLE I PAGE 1A RTICLE IG ENERAL DUTIES AND RESPONSIBILITIES OFA SSOCIATED STUDENT ORGANIZATION OFFICERS(01.01.000) Section 1 - General Duties (01.01.010) In addition to the specific responsibilities of their individual offices, all members of the Associated Student Organization (ASO) must perform the following duties: (01.01.020) A) Attend all regular and committee meetings as required by his/her particular office and committee assignments. (01.01.030) B) Maintain a minimum of three (3) regularly scheduled office hours per school week, one hour of which must be served in some area of high circulation and visibility besides the ASO office. (01.01.031) 1) The hour of outside circulation may be obtained in campus employment, when such employment involves direct contact with a large volume of students. (01.01.040) C) Devote time for individual projects, activities, committee assignments and any additional tasks necessary to achieve the goals and objectives of the ASO. (01.01.050) D) Maintain and uphold the Associated Students of Palomar College (ASPC) Constitution, ASO Bylaws, and the Policies and Procedures of the ASO. (01.01.060) E) Review and approve the ASO's annual budget. (01.01.070) F) Serve on a minimum of one (1) (01.01.080) G) Represent the interests of all students enrolled at Palomar College. (01.01.090) H) Retain the power to override a Presidential veto by a two-thirds majority vote, a quorum being present. (01.01.100) I) Retain the privilege to vote on all ASO matters, except the President, who shall vote only in case of a tie or when a super majority is required. (01.01.110) Failure to fulfill these minimum requirements shall result in the officer in question being held accountable to an Executive Review pursuant to Article VIII, with the possibility of a vacancy being declared by the President, subject to confirmation by a majority vote of the ASO, a quorum being present. BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE I PAGE 2(01.02.000) Section 2 – Voting Members and Specific Duties of Officers (01.02.010) The voting membership of the Associated Student Organization shall consist of the President, the Vice-President, and fourteen (14) Senators. The duties inherent to the aforementioned offices shall be as follows: (01.02.020) A) President (01.02.021) 1) Call and chair all meetings of the ASO in accordance with the organization's recognized parliamentary authority. (01.02.022) 2) Serve as the Student Trustee of the Palomar College Board of Trustees and attend all Governing Board meetings. The Student Trustee's term of office shall be in accordance with these Bylaws. (01.02.023) 3) Shall attend the Strategic Planning Council meeting or designate an ASO member to attend in his/her place. (01.02.024) 4) Appoint student representatives to ASO committees and to College committees subject to confirmation by the ASO. Appointments shall be approved by a simple majority unless otherwise noted in Bylaws that pertain to the position. The President can remove or replace members of a committee subject to confirmation by a simple majority of the ASO unless otherwise stated in the Bylaws. (01.02.025) 5) Serve as an Ex-officio member of all committees of the ASO. (01.02.026) 6) Shall take appropriate actions as President of the Associated Students of Palomar College, but is accountable to ASO for said actions. (01.02.027) 7) Shall oversee all matters connected with the collection and disbursement of A.S.P.C. funds. (01.02.028) 8) Shall retain the power to veto actions and resolutions passed by the ASO. (01.02.029) 9) May appoint ASO Senators as Interim Officers as such positions become vacant and until they can be filled by normal procedures. Senators appointed to Interim positions remain Senators. (01.02.030) B) Vice-President (01.02.031) 1) Shall assume the duties of the President in his/her absence. (01.02.032) 2) Shall succeed to the office of the President upon his/her vacancy of office (01.02.033) 3) Shall coordinate all committee business and monitor ASO officer compliance with Section 1 of this Article (01.01.000 et seq.). BYLAWS ARTICLE I PAGE 3(01.02.034) 4) Shall chair the ASO Committee on Policies, Procedures and Executive Review. (01.02.035) 5) Shall attend all meetings of the Faculty Senate or request that the President designate another ASO member to attend in his/her place. (01.02.036) 6) Shall assume additional duties as assigned by the President. (01.02.040) C) Senators (01.02.041) 1) Attend and actively participate at ASO meetings, ASO committee meetings and Palomar College Governance committees according to their individual assignments. (01.02.042) 2) Keep informed on state, local, and college policies that relate to the general welfare of all the Associated Students of Palomar College. (01.02.043) 3) Be responsive to the wishes of all the students of Palomar College. (01.02.044) 4) Shall initiate legislation, draft resolutions, formulate policies, develop codes and Bylaws, and create ad-hoc committees as deemed necessary and proper. (01.02.045) 5) Shall confirm all Presidential appointments by a majority vote unless otherwise noted in the Bylaws that pertain to the appointment. (01.02.046) 6) Shall act as a standing budget committee. (01.03.000) Section 3 - Non-voting members (01.03.010) The non-voting members of the ASO shall include the following offices and any other member appointed by the ASO President and approved by a majority vote, or appointed by an ASO resolution. (01.03.020) A) Secretary (01.03.021) 1) Funds shall be appropriated to employ a secretary to perform official clerical duties of the ASO. (01.03.022) 2) Shall keep accurate written minutes of proceedings transacted during ASO meetings and maintain a complete and accurate file of all such meetings. (01.03.023) 3) Shall perform any other functions as deemed necessary by the President of the ASO or a majority vote of the ASO. (01.03.030) B. Student Delegates (01.03.031) 1) Special Assignments (01.03.031[a]) a) Shall attend and be prepared to give a report one ASO meeting every month (01.03.031[b]) b) Shall be an official representative of the ASO in matters that relate to their assignment. BYLAWS ARTICLE I PAGE 4(01.03.031[c]) c) Keep informed on state, local and college policies and any other information pertaining to their assignment (01.03.031[d]) d) Be responsive to the wishes of all students of Palomar College in regards to the delegates’ assignment (01.03.031[e]) e) Shall assume additional duties as assigned by the President or a majority vote of the ASO. (01.03.032) 2) Committees (01.03.032[a]) a) Attend and actively participate at the ASO Committee meetings according to each individual assignment (01.03.032[b]) b) Keep informed on information and college policies that relate to their committee(s). (01.03.032[c]) c) Be responsive to the wishes of all students of Palomar College in regards to the delegate’s committee(s) (01.03.032[d]) d) Shall assume additional duties as assigned by the President or a majority of the ASO. ADOPTED 10/21/1992 REVISED 08/28/1996, 01/23/2002, 08/19/2004, 03/09/2005 BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE II PAGE 5A RTICLE IIM EETINGS(02.01.000) Section 1 – Types of Meetings (02.01.010) A) The ASO shall publish and abide by a schedule of not less than two (2) meetings per month. These meetings shall be open to all members of the A.S.P.C. who wish to attend in accordance with Calif. Gov. Code Sections 54950-54963. (02.01.020) B) The Presiding Officer shall call the roll for the General Session promptly at 1:00pm. All members not present at the time of roll call shall be marked tardy or absent. (02.01.030) C) Special meetings of the ASO may be called by the President or by a two-thirds (2/3) majority vote of the ASO when it is deemed necessary and is duly noticed in accordance with Section 54956 of the California Government Code. Minutes of special meetings will be made available upon request. (02.01.040) D) The ASO shall be allowed to conduct business in accordance with the guidelines set forth in the Constitution and these Bylaws during the summer and winter so long as actions taken by participating members are presented in report form at the first regular meeting of the next semester. (02.02.000) Section 2 - Parliamentary Authority, Quorum and Absences (02.02.010) A) All meetings shall be conducted according to Robert's Rules of Order, newly revised. (02.02.020) B) A quorum should be established before any business can be acted upon by the ASO. A quorum shall consist of fifty (50) percent of the voting members as defined in Article I, Section 2 (01.02.000 et seq.). (02.02.030) C) Any voting member of the ASO with three (3) consecutive or five (5) total unexcused absences from the General Session in any one academic year shall be immediately disqualified by the President, subject to confirmation by a majority vote of the ASO. (02.02.040) D) Absences or tardiness will be excused only when the member's failure to attend a meeting is a direct result of one of the following reasons: (02.02.041) 1) An official Campus Shared Governance Committee. (02.02.042) 2) An officially ASO recognized meeting or conference. (02.02.043) 3) A verifiable medical emergency. (02.02.044) 4) The meeting missed is a special or emergency meeting which conflicted with a prior obligation. BYLAWS ARTICLE II PAGE 6(02.02.045) 5) Any other reason deemed excusable by a two-thirds (2/3) majority vote of those present and voting at the subsequent regular meeting. (02.03.000) Section 3 - Agendas (02.03.010) A) An Agenda shall be prepared by the President and posted publicly in the glass display case at the north wing of the Student Union near the elevator no later than seventy-two (72) hours prior to the General Session, pursuant to Section 54954.2 of the California Government Code. (02.03.011) 1) Copies of the Agenda must be available to all members of the ASO no later than twenty-four (24) hours prior to the General Session, though it is preferable that Agendas be made available as early as possible to allow for research of issues to be discussed. (02.03.020) B) Special Meeting Agendas must be posted publicly no later than twenty-four (24) hours prior to the meeting. (02.03.030) C) Every Agenda for meetings of the ASO shall provide reasonable time for public commentary on items which are listed on said Agenda, pursuant to Section 54954.3 of the California Government Code. (02.03.031) 1) There shall also be established a segment of the Agenda for public comment on items which are not otherwise listed on the Agenda and which fall under the jurisdiction of the ASO; however, action on such items is prohibited by law (Section 54954.2 of the California Government Code) until otherwise placed on an official Agenda ADOPTED 10/21/1992 REVISED 11/22/1995, 03/09/2005 BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE III PAGE 7A RTICLE IIIASO C OMMITTEES(03.01.000) Section 1 - General (03.01.010) A) Committee members shall be selected by Presidential appointment, subject to approval by a two-thirds (2/3) majority vote of the ASO. (03.01.020) B) All committee chairs shall appoint a vice-chair to run the committee in his/her absence. (03.01.030) C) Ad-hoc committees may be created as needed to deal with special events or problems by a majority vote of the ASO meeting in General Session. (03.01.040) D) Any officer serving on a committee who is absent without excuse from two (2) consecutive or four (4) cumulative of the committee's meetings in any one academic year shall be subject to the ASO's disciplinary policy pursuant to Article VIII. (03.01.050) E) Absences from committee meetings shall be held to the same criteria for excuse defined in Article II, Section 2, Subsection D (02.02.040). (03.02.000) Section 2 - Committee on Policies, Procedures and Executive Review (03.02.010) A) The Committee on Policies, Procedures and Executive Review shall be chaired by the Vice-President. (03.02.020) B) Voting membership shall consist of the Vice-President, at least three (3) additional members of the ASO, and up to two (2) student delegates. (03.02.030) C) The Committee on Policies, Procedures and Executive Review shall meet on an as-needed basis, unless otherwise directed by the President or a majority of the ASO. (03.02.040) D) The duties of this Committee shall be as follows: (03.02.041) 1) Monitor and enforce ASO office hours. (03.02.042) 2) Review the ASO Constitution, Bylaws, and Policies and recommend changes when deemed necessary. (03.02.043) 3) Monitor ASO officer compliance with the other conditions of office as set forth in Article I, including attendance at ASO meetings and College Shared Governance meetings. (03.02.044) 4) Monitor ASO officer compliance with reporting procedures on both assigned committee business and College Shared Governance meetings. (03.02.045) 5) Review those officers who have been brought up on violations of ASO policy or BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE III PAGE 8procedure as set forth in these Bylaws and in the adopted Policies of the Board pursuant to Article VIII, and make recommendations to the President and to the ASO Board regarding enforcement of disciplinary provisions. (03.02.046) 6) Any additional duties as deemed necessary by the ASO. (03.03.000) Section 3 - Committee on Legislation and External Affairs (03.03.010) A) The Committee on Legislation and External Affairs shall be chaired by an ASO Senator appointed by the President. (03.03.020) B) Voting membership shall consist of the appointed Chairperson, at least three (3) additional ASO officers, and up to two (2) student delegates. (03.03.030) C) The Committee on Legislation and External Affairs shall meet on an as-needed basis, unless otherwise directed by the President or a majority of the ASO, and may be referred to in title by the particular event or issue which is under discussion (in lieu of the proper codified title listed herein). (03.03.040) D) The duties of this Committee shall be as follows: (03.03.041) 1) Secure and maintain sources of information on legislation (i.e. LegiTech, Statement, California Journal, etc.) (03.03.042) 2) Initiate and maintain relations with local legislators through personal visits, phone calls, and written correspondence. (03.03.043) 3) Invite local legislators to the campus. (03.03.044) 4) Analyze and disseminate information on legislation to the Palomar College student body. (03.03.045) 5) Collect and consider the input of the Palomar College student body on legislative issues and formulate positions on those subjects. (03.03.046) 6) Any other duties as deemed necessary by the ASO. (03.04.000) Section 4 - Committee on Campus-wide Activities (03.04.010) A) The Committee on Campus-wide Activities shall be chaired by an ASO Senator appointed by the President. (03.04.020) B) Voting membership shall consist of the appointed Chairperson, at least three (3) additional ASO officers, and up to two (2) student delegates. (03.04.030) C) The Committee on Campus-wide Activities shall meet on an as-needed basis, unless otherwise directed by the President or a majority of the ASO, and may be referred to in title by the particular BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE III PAGE 9event which is being planned (in lieu of the proper codified title listed herein). (03.04.040) D) The duties of the Committee shall be as follows: (03.04.041) 1) Actively publicize and promote the programs and activities of the ASO. (03.04.042) 2) Locate and secure bands, guest speakers, and other forms of entertainment to appear on a regular basis. (03.04.043) 3) Revise, circulate, and compile the results of the ASO student interest survey. (03.04.044) 4) Any other duties as deemed necessary by the ASO. (03.05.000) Section 5 - Inter-Club Council (03.05.010) A) The Inter-Club Council shall be chaired by an ASO Senator appointed by the President. (03.05.020) B) Voting membership shall consist of campus clubs. The appointed Chairperson shall cast tie-breaking votes. (03.05.030) C) ASO Officers will assist the committee chair with any tasks needed to benefit the ICC. (03.05.040) D) Specific codes and provisions regarding the Inter-Club Council are noted in Article XV (15.01.000 et seq.) of these Bylaws. ADOPTED 11/18/1992 REVISED 04/09/1997, 01/23/2002, 03/09/2005 BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE IV PAGE 10A RTICLE IVI NITIATIVE, REFERENDUM, RECALL AND IMPEACHMENT(04.01.000) Section 1 - Initiative (04.01.010) The qualifications and process for submitting an Initiative shall be as follows: (04.01.020) A) Obtain the signatures and student I.D. numbers from three (3%) percent of the San Marcos Campus Fall enrollment of the A.S.P.C. in support of the proposed legislation. (04.01.030) B) Submit the proposals for the initiative to the ASO to be referred to the Committee on Policies, Procedures and Executive Review for a review of the constitutionality of the submitted proposals, such review to be completed within a time period not to exceed twenty (20) regularly-scheduled school days. (04.01.040) C) After review of the proposal and verification of the signatures and the I.D. numbers by the Student Activities Office, the measure will be put to the student body for a vote. An Election Committee shall be formed and a Special Election held within (20) regularly-scheduled school days, unless a regular ASO election is held during this period, in which case the initiative will be put to the students at the regular election. (04.01.050) D) Required to pass the measure shall be a majority of the votes cast in favor of said proposal (04.01.060) E) (04.02.000) Section 2 - Referendum (04.02.010) The qualifications and process for submitting a Referendum to the Associated Students of Palomar College shall be as follows: (04.02.020) A) The measure or proposal must be on the Agenda for information at a meeting for discussion at least one week before the ASO can vote to submit the measure/proposal to the A.S.P.C. for voting. (04.02.030) B) The measure must be referred to the Committee on Policies, Procedures and Executive Review to determine if the proposed referendum is constitutional. (04.02.040) C) The ASO must refer the proposal to the students by a majority vote of members present. (04.02.050) D) Required to pass the measure shall be two-thirds (2/3) of the votes cast in favor of said proposal. (04.02.060) E) (04.03.000) Section 3 - Recall (04.03.010) Any person holding an elected or non-paid, appointed position of the ASO shall be subject to recall according to the following procedure: BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE IV PAGE 11(04.03.020) A) A Petition for Recall shall be circulated by students who are qualified as follows: (04.03.021) 1) Petitioners must submit their names and Student Identification Numbers to the Office of Student Affairs for verification of enrollment. (04.03.022) 2) The petitioners must be currently enrolled in classes at Palomar College and be free from any disciplinary restrictions. (04.03.030) B) Individuals wishing to circulate recall petitions must present their reasons for such to the ASO in a regular or special meeting. (04.03.040) C) Before the petition is circulated it must be verified by the Student Activities Office to contain the following: (04.03.041) 1) The names and positions of the officers to be recalled (04.03.042) 2) A statement, not less than fifty (50) nor more than two-hundred-fifty (250) words in length, explaining the reasons for the recall. (04.03.043) 3) A rebuttal written by the officers to be recalled (04.03.044) 4) Petitions should be numbered by the Office of Student Affairs and signed by the Director of Student Affairs in order to ensure authenticity. (04.03.050) D) The Student Identification Numbers and signatures of five (5%) percent of the total number of students registered at Palomar College San Marcos campus (based on the first census of the semester) shall be required to have the recall placed on a ballot. (04.03.060) E) Petitioners shall have not more than twenty (20) regularly-scheduled school days from the time of petition verification to submit the completed petition with the required amount of signatures for the recall to be declared valid. (04.03.070) F) The ASO shall hold a recall
election within fifteen (15) regularly-scheduled school days
after verification of the signed petition by the Office of
Student Affairs, unless a regular ASO election (04.03.080) G) The recall election shall be held in accordance with Article V (Election Code) of the ASO Bylaws where appropriate. Decisions relating to applicability of individual provisions of the Election Code to a recall election (excepting sections relating specifically to recalls) shall be made by the appointed Election Committee, subject to reversal by the whole ASO. (04.04.000) Section 4 - Impeachment (04.04.010) A) Any elected or non-paid appointed ASO officer shall be subject to impeachment by his/her fellow officers. BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE IV PAGE 12(04.04.020) B) Impeachment shall only be used to remove officers from their positions in extreme cases, including, but not limited to the following: (04.04.021) 1) Proven violations of the Student Conduct Code. (04.04.022) 2) Flagrant and/or continuous abuse of the power of his/her position. (04.04.023) 3) Serious and recurring disregard for the inherent duties of his/her office. (04.04.024) 4) Any other conduct deemed by a two-thirds (2/3) majority vote of the ASO to be unbecoming of an ASO Officer. (04.04.030) C) The ASO can impeach any member thereof in concurrence with the conditions above and by adhering to the following procedure: (04.04.031) 1) An ASO officer considering impeachment of another ASO officer must, as the first step in the procedure, arrange for a meeting with the Director of Student Affairs and the officer(s) he/she is considering impeaching to discuss the issues leading to the impeachment. (04.04.032) 2) A written notice from the Accusing Officer(s) stating the reason(s) for the impeachment will be given to the officer(s) in question before any impeachment process may begin. (04.04.033) 3) Submit a resolution with the signatures of five (5) ASO officers to the President stating the reasons for impeachment so that it may be placed on the Agenda for the next regularly scheduled weekly meeting, in accordance with Article II. (04.04.034) 4) The resolution must be considered as information only when it is first placed on the Agenda. Five (5) school days must pass before impeachment can be considered for action. (04.04.035) 5) The officer being impeached must be present at both the information and the action meeting. (04.04.036) 6) No resolution for impeachment shall apply to more than one (1) ASO officer. (04.04.037) 7) The ASO shall vote on the resolution. Should a two-thirds (2/3) majority of the votes cast favor impeachment, the officer shall immediately be considered removed from office. ADOPTED 12/14/1992 REVISED 04/10/1996, 03/09/2005 BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH ARTICLE HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 13A RTICLE VE LECTION CODE(05.01.000) Section 1 - Regular Election Code (05.01.010) A) Election Committee (05.01.011) 1 ) The President shall appoint an Election Committee consisting of at least three (3) members and designate the Chairperson of the Election Committee. The Election Committee must be approved by a majority vote of the ASO. The Election Committee shall be responsible for setting up the balloting station, counting the ballots, and carrying out the general duties required at election time.(05.01.011[a]) a) No student running for election or assisting in the election campaign of a candidate may serve on the Election Committee. (05.01.011[b]) b) (05.01.011[c]) c) The Director of Student Affairs shall serve as an Ex-Officio member of the Election Committee. (05.01.020) B) Eligibility and Maintenance Requirements (05.01.021) 1) All prospective candidates for an ASO office shall file an Election Application, so eligibility can be ascertained, no later than 12:00 Noon, five (5) school days prior to the election. (05.01.021[a]) a) Saturday instructional days shall not be counted for the purposes of determining the deadline for Application submission. (05.01.021[b]) b) The Election Application can be picked up twenty-four (24) school days prior to the election at the Office of Student Affairs. (05.01.022) 2) To be eligible to run for office, a candidate must meet the following criteria: (05.01.022[a]) a) A student pursuing office or a position in the ASO must be qualified as a regular-status student as defined in Article XIV, below, or as otherwise qualified by the Governing Board, BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. (05.01.022[b]) b) Obtain the signatures and student identification numbers of fifty (50) enrolled Palomar College students (05.01.022[c]) c) Possess a cumulative GPA of at least 2.5 upon initial participation in student government (05.01.022[d]) d ) Notwithstanding any other provision of this Bylaw, the Director of Student Affairs shall have sole discretion in determining the GPA of a potential applicant for an ASO position.(05.01.022[e]) e) A student shall be ineligible for election or appointment for a period of three (3) semesters if they have previously served as an officer of the Palomar College ASO, and resigned or were subsequently removed from office for disciplinary reasons, or as a result of academic or progress probation. (05.01.022[f]) f) Any officer who resigns or is disqualified, recalled, or impeached twice within any period is ineligible for election or appointment. (05.01.022[g]) g) Any executive officer who, due to disqualification, recall, impeachment, or resignation shall not be eligible for election or appointment to any executive position at any time thereafter. (05.01.022[h]) h) If a candidate for a position in the Associated Student Organization is employed by Palomar College as a Classified staff member, please refer to Article V, Section 4, below (05.04.000 et seq.) BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 15(05.01.022[i]) i) Faculty, both full-time and adjunct, shall be prohibited from serving as members of the Associated Student Organization in any capacity other than that of advisor to the Board. (05.01.022[j]) j) Administrators at any level in the college governance structure shall be prohibited from serving as members of the Associated Student Organization in any capacity other than that of advisor to the Board. (05.01.023) 3) For an officer to maintain office in ASO, the following conditions apply: (05.01.023[a]) a) Maintain a semester GPA of at least 2.5 throughout the officer's tenure in office (05.01.023[b]) b) Maintain (and complete) a course load of at least 10 units during each semester while serving as an officer in ASO. (05.01.023[c]) c) Receipt of a grade of "FW" in a course shall not be deemed as satisfactory completion of the requirements of subsection 2f, above (05.01.022[f]), unless otherwise determined by the Director of Student Affairs. (05.01.023[d]) d) A grade of "I," if received during the course of a semester and removed before the start of the next semester, will be deemed satisfactory for the completion of subsection 3(b), above (05.01.023[b]), subject to confirmation and at the discretion of the Office of Student Affairs. (05.01.023[e]) e) All officers are required to enroll in the Leadership and Communication (Speech 165: 3 units) course offered for members of ASO. Subsequent semesters of ASO will be assigned a different course number upon approval. BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 16(05.01.023[f]) f) It shall be at the discretion of the Director of Student Affairs to waive the required coursework noted in subsection 3(e) (05.01.023[e]), above, for financial or other valid reasons as determined by that Office. (05.01.023[g]) g) No more than six (6) units per semester may be taken credit/no credit during the officer's tenure in office (05.01.030) C) Candidates' Meeting (05.01.031) 1) All candidates will be required to attend at least one of three (3) Candidates' Meetings to receive pertinent information on the election, publicity procedures, and Special Rules. (05.01.032) 2) At these meetings, all candidates will be given a statement which they must sign acknowledging that they have read and understand the Election Bylaws. (05.01.032[a]) a) Statements must be returned to an Election Committee member or the Office of Student Affairs before campaigning can commence. (05.01.033) 3) The dates and times of said meetings shall be established and made known by the Election Committee. Additional meetings may be scheduled at the discretion of the committee. (05.01.034) 4) Should any otherwise qualified candidate fail to attend a Candidate's meeting, he or she will be prohibited from engaging in any kind of publicity or campaigning. (05.01.035) 5) The time and date of the third Candidate's Meeting shall be not less than five (5) school days prior to the election. (05.01.040) D) Election Information Packet (05.01.041) 1) The Election Committee Chairperson will make available to all candidates an Election Information Packet. The Packet shall include the following: (05.01.041[a]) a) An election calendar detailing the time and dates of the campaigning period, the candidates' meetings, any debates, as well as the dates of the election. BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 17(05.01.041[b]) b) A copy of Articles I and V of the Associated Student Organization Bylaws. (05.01.041[c]) c) A copy of the Palomar College Publicity Regulations. (05.01.041[d]) d) The location of the balloting station(s) and their exact physical boundaries. (05.01.041[e]) e) Other pertinent election information. (05.01.050) E) Publicity (05.01.051) 1) All campaign publicity will be governed by the Palomar College Publicity Regulations available in the Office of Student Affairs. In addition, the following regulations apply to Campaigns and Electioneering: (05.01.051[a]) a) Any questions as to the legality of campaign literature, speeches, or events shall be referred to the Election Committee for review. (05.01.051[b]) b) All campaign publicity will meet generally-accepted standards of what is constructed to be fair and in good taste. Each candidate will be held responsible by the Election Committee for any misconduct of campaign publicity. (05.01.051[c]) c) Tampering with authorized campaign literature is prohibited and may result in the disqualification of candidates accused and found guilty of such behavior from the election. (05.01.051[d]) d) Each candidate shall be limited to a total campaign expenditure of one hundred ($100) dollars. Candidates will be required to turn in all campaign expenditure receipts along with their campaign expenditure receipts along their Campaign Expenditure Form. Candidates found to have exceeded their limit or falsified their campaign expenditures shall be disqualified. BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 18(05.01.051[e]) e) All campaign items will be removed by the candidates or his/her representatives from the inside of the Student Union by 4:00pm the day before the commencement of the election. (05.01.060) F) Candidate Publicity Conference (05.01.061) 1) The Election Committee will organize a Public Forum ("Meet the Candidates Day") within the five (5) day period before voting commences. This conference will consist of the following: (05.01.061[a]) a) A public reading of the election calendar. (05.01.061[b]) b) An introduction of the candidates. (05.01.061[c]) c) A period where the candidates may announce their platforms/goals/objectives. (05.01.061[d]) d) A question and answer period between the candidates and the press/public. (05.01.061[e]) e) The Election Committee will decide the exact time and date of the forum. (05.01.070) G) Ballot (05.01.071) 1) The Election Committee will draft a ballot. The names of the candidates will appear on the ballot according to a random alphabet drawn by the Election Committee at the first Candidate Meeting. (05.01.072) 2) The preferential treatment of any incumbent officeholder or ASO member who is seeking re-election or election to a new position is specifically prohibited. (05.01.080) H) Balloting Station(s) (05.01.081) 1) Unless otherwise stated and established by two-thirds (2/3) majority of the sitting ASO Board, all balloting for elections of the ASO shall be conducted via the Internet, to be monitored by the Office of Student Affairs. (05.01.082) 2) Computer access is provided to students at on-campus computer labs, the Library, and at other Internet-accessible locations throughout the main campus and all satellite campuses. Students are further encouraged to vote at home via the online election system. However, the following stipulations shall be applied to on-campus locations: BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 19(05.01.082[a]) a) On the days of the Election, no campaigning or electioneering shall be allowed within twenty-five (25) feet of a designated balloting station, on-campus computer lab, or the Student Union. (05.01.082[b]) b) The Election Committee shall establish and maintain a balloting station in the ASO Office (SU-102) for the duration of the election. (05.01.090) I) Terms of Office/Election Dates (05.01.091) 1) The exact dates for elections shall be established by the ASO according to the following criteria: (05.01.091[a]) a) The election for the offices of ASO President and ASO Vice-President will be held not later than the third week in May. (05.01.091[b]) b) Terms of office for ASO President and Vice-President shall commence on the day following certification of the election and end on the date of certification of the subsequent election. Terms of office for all other officers of the ASO will commence on the day of appointment and terminate one (1) year from the date of appointment, starting with Senators appointed after June 2005. Terms of office for Senators appointed prior to June 2005 shall terminate on December 31st of that year. (05.01.091[c]) c) The fourteen (14) Senator positions will be appointed from a list of applicants stating a desire to serve, who have met all requirements as set forth in these bylaws. Appointments will be made by a majority vote of a committee comprised of the ASO President, Vice-President, another ASO Senator currently BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 20serving on the Board, the Director of Student Affairs (or his/her designee), and the Coordinator of Student Activities. Vacancies among the fourteen senator positions will be filled as they become available from the list of qualified applicants for the position. All applicants must be interviewed by at least three members of the appointing committee prior to being considered for appointment. (05.01.091[d]) d) Senators who are appointed by this process throughout the year shall be introduced and appointed to the ASO at the meeting subsequent to the meeting of the appointment committee. Those senators assume all duties and responsibilities at that time, and are subject to ratification at the ASO General Session two (2) weeks following their initial appointment. (05.01.091[e]) e) Senators who apply for reappointment subsequent to immediate active membership and are reappointed to their Senatorial position shall have their second probationary period waived, notwithstanding any other provision of this Bylaw. (05.01.100) J) Tabulation of Votes (05.01.101) 1) Tabulation of all ballots by the Election Committee shall be completed as quickly as possible, but not later than two (2) school days after the close of the balloting. (05.01.101[a]) a) Official notice of the tabulations shall be certified by the signature of the Election Committee Chairperson and the Director of Student Affairs. (05.01.101[b]) b) Results shall be posted in the Comet Center, Student Union, Office of Student Affairs, and the BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 21ASO Office by 8:00 am on the first day following tabulation and remain posted for five (5) school days. (05.01.101[c]) c) Requests for a recount must be filed with the Election Committee within twenty-four (24) hours after election results are posted. (05.01.110) K) Enforcement of Code (05.01.111) 1) The Election Committee will be responsible for upholding and enforcing all articles of the Election Code. (05.01.112) 2) Any candidate or member of the candidate's committee accused of a violation of the Election Code will appear before the Election Committee at an Open Hearing. The Election Committee will decide if the charges filed are of significant magnitude to warrant disqualification. (05.01.112[a]) a) Should a candidate be disqualified by the Election Committee for whatever reason before the date of the election, the name of the disqualified candidate shall be struck from the ballot. (05.01.112[b]) b) Should a candidate be disqualified by the Election Committee for whatever reason while the election is being conducted, a public notice of disqualification shall be immediately posted at all physical balloting stations, in the glass case at the north wing of the Student Union, and on the election website. Votes cast for a disqualified candidate shall be deemed invalid if cast subsequent to the date of disqualification. (05.01.112[c]) c) Should the Election Committee determine that a disproportionate number of students are disenfranchised by the disqualification of a given candidate, the Committee may choose to order a special election BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 22for the specific office for which the disqualified party declared candidacy. (05.01.112[d]) d) Should a candidate be disqualified by the Election Committee following an election, and that candidate prevailed in obtaining office in the ASO, the Chairperson of the Election Committee shall be required to declare the contested seat vacant at the subsequent General Session of the ASO, pursuant to the provisions of this Bylaw. (05.01.112[e]) e) If a seat is declared vacant by the Election Committee, a special election shall be held to fill the seat, within the time provisions as otherwise outlined in Section 3 (05.03.000), below, of this Bylaw. (05.01.112[f]) f) If there is but one other candidate for the contested office, it shall be at the discretion of the Election Committee to enforce the Special Election described in Section 3 of this Bylaw by a two-thirds (2/3) majority. The Committee may instead opt to declare the remaining candidate the winner of the seat, subject to confirmation by a two-thirds (2/3) majority of the sitting ASO board, and with careful consideration of point c (05.01.112[c]), above. (05.01.112[g]) g) Notwithstanding any other provision of this Bylaw, the Director of Student Affairs, acting in his or her capacity as the advisor to the ASO, may make the declaration of disqualification in consultation with the President and the Chairperson of the Election Committee, should he or she find a student otherwise BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 23unqualified for candidacy at any time. (05.02.000) Section 2 - Recall Election Code (05.02.010) A) Recall Election Committee (05.02.011) 1) The Recall Election Committee shall consist of three (3) members of the ASO and two (2) members of the ICC. These members shall be chosen by random selection to serve on the committee, and cannot be named in the recall or be actively supporting or opposing the recall effort. (05.02.012) 2) The Recall Election Committee must be approved by a majority vote of the ASO. (05.02.013) 3) The Recall Election Committee shall elect a chairperson from their membership. (05.02.014) 4) The Recall Election Committee shall be responsible for the setting up the balloting station, counting ballots, and carrying out the general duties required at election time, pursuant to the same provisions outlined in Section 1 (05.01.000 et seq.) above. (05.02.015) 5) No ASO Officer who is being recalled or any student actively involved with the recall effort can serve on the Recall Election Committee. (05.02.016) 6) It shall be the responsibility of the Recall Election Committee to ensure that the Recall is valid pursuant to Article IV of these Bylaws. (05.02.017) 7) (05.02.018) 8) The Director of Student Affairs shall serve as an ex-Officio member of the Recall Election Committee. (05.02.020) B) Recall Election Procedure Meeting (05.02.021) 1) The Recall Election Committee shall meet twice within five (5) days of the recall petition's verification to discuss election procedures and campaign regulations. (05.02.022) 2) All members being recalled and any students actively campaigning for the removal of the Officers must attend one of these meetings. (05.02.023) 3) The exact date and time of the meetings shall be set by the Recall Election Committee. Copies of Article V, Section 2 of the Bylaws (05.02.00 et seq.) shall be made available at these meetings. (05.02.030) C) Election Information (05.02.031) BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 24(05.02.040) D) Campaign and Electioneering (05.02.041) 1) All campaign publicity will be governed by the Palomar College Publicity Regulations available in the Office of Student Affairs. (05.02.041[d]) d) All campaign items will be removed from the inside of the Student Union by 4:00pm the day before the commencement of the election. (05.02.050) E) Recall (05.02.051) 1) The Recall Election Committee will organize a Recall Forum not less than five (5) days before voting commences. This forum shall provide an opportunity for all the candidates to give a presentation, debate, and/or answer questions from the student body. (05.02.051[a]) a) The Recall Election Committee will decide the Forum's exact time and date, as well as the rules and format. (05.02.060) F) Publicity Expenditures (05.02.061) 1) The costs of producing publicity or any "recall material" will be assumed by the students campaigning to recall ASO officers, not to exceed one hundred dollars ($100) expended or received. (05.02.062) 2) Associated Student Organization funds shall not be used to purchase/copy materials or pay for any other activities in relation to the support or opposition of the recall. (05.02.070) G) Ballot (05.02.071) 1 (05.02.072) 2) The ballot shall contain language directing the voter to either approve or deny the recall of the specified officer(s), BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 25and shall also provide a listing of available candidates to succeed to the positions indicated should the recall be successful. (05.02.072[a]) a) Multiple officers to be recalled should be listed separately, to allow the electors an opportunity to vote on each officer individually. (05.02.072[b]) b) The listing of qualified candidates shall be randomly ordered in accordance with Section 1, Subsection G (05.01.070 et seq.) of this Bylaw. (05.02.080) H) Tabulation of Votes (05.02.081) 1) Tabulation of all ballots by the Recall Election Committee shall be completed as quickly as possible, but not later than two (2) school days after the closing of the election. (05.02.081[a]) a) Official notice of the tabulations shall be certified by the signature of the Inter-Club Council Chairperson and the Director of Student Affairs. (05.02.081[b]) b) Results shall be posted in the Comet Center, Student Union, Office of Student Affairs, and the ASO Office by 8:00 am on the first day following tabulation and remain posted for five (5) school days. (05.02.081[c]) c) Requests for a recount must be filed with the Recall Election Committee within twenty-four (24) hours after election results are posted. (05.02.090) I) Enforcement of Code (05.02.091) 1) The Recall Election Committee will be responsible for upholding and enforcing all articles of the Recall Election Code. (05.02.092) 2) Any officer indicted by the recall or any participant campaigning for the removal of an officer who is accused of a violation of the Recall Election Code will appear before the Recall Election Committee at an Open Hearing. The Election Committee will decide if the charges filed are of significant magnitude to warrant nullification of the recall effort or immediate removal of the offending ASO member from office. BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 26(05.03.000) Section 3 - Special Election in the Event of Disqualification (05.03.010) A) Conditions Required for a Special Election (05.03.011) 1) Should there be a disqualification as noted in Section 1, Subsection L, Number 2, points c through g (05.01.112[c] to [g]), a Special Election shall be held to determine a replacement for the office otherwise vacated by the disqualified candidate. (05.03.012) 2) The Election Committee named to oversee the original election shall maintain control over the subsequent Special Election. (05.03.020) B) Eligibility (05.03.021) 1) Candidates for the seat left vacant by the disqualification must file an Election Application to the Office of Student Affairs no later than 12:00 Noon five (5) school days prior to the scheduled date of the Special Election. (05.03.021[a]) a) A candidate who was originally qualified for the original election need not file a new application; rather, a Statement of Requalification must be signed and submitted to the office of Student Affairs no later than 12:00 Noon five (5) school days prior to the Special Election. (05.03.021[b]) b) The disqualified candidate(s) from the previous election is/are specifically prohibited from reapplying for the position(s) in question in the Special Election. (05.03.021[c]) c) Saturday instructional days shall not be counted for the purposes of determining the deadline for Application submission. (05.03.021[d]) d) Special Election applications shall be made available on the Monday immediately following declaration of disqualification and vacancy at the ASO General Session subsequent to the original General Election. (05.03.021[e]) e) Should the Monday immediately following the declaration of disqualification and vacancy at the ASO General BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 27Session be a recognized school holiday, applications shall be made available on the first regular school day after the Monday described in subpoint d (05.03.021[d]), above. (05.03.022) 2) Eligibility for candidacy and for office shall be the same as for other candidates, as described in Section 1, Subsection B, Number 2 a) to q) (05.01.022 et seq.) of this Bylaw. (05.03.030) C) Candidates’ Meeting (05.01.031) 1) All candidates shall be required to attend a meeting to receive pertinent information on the election, publicity procedures and other Special Rules. (05.01.032) 2) A signed statement shall be required of all candidates, acknowledging receipt and understanding of the entirety of this Election Code and an Election Information Packet as described in Section 1, Subsection D (05.01.040 et seq.) of this Bylaw. (05.03.040) D) Election Calendar and Forum (05.03.041) 1) The Special Election shall be held in a timely and expedient manner, with the date of election not later than thirty (30) days, but no earlier than fifteen (15) days, following the close of the previous General Election (05.03.042) 2) A Special Election Forum shall be held not earlier than five (5) school days prior to the scheduled date of the Election, to discuss issues of relevance to the campus community and to allow candidates an opportunity to meet with constituents of the campus community. (05.03.050) E) Publicity (05.03.051) 1) All campaign publicity shall be conducted in accordance with Section 1, Subsection E (05.01.050 et seq.) of this Bylaw. (05.03.060) F) Ballot and Balloting Stations (05.03.061) 1) All balloting provisions for the Special Election shall be done in accordance with Section 1, Subsections G and H (05.01.070 et seq. and 05.01.080 et seq.) of this Bylaw. (05.03.070) G) Tabulation (05.03.071) 1) All tabulation of votes for the Special Election shall be done in accordance with Section 1, Subsection K (05.01.100) of this Bylaw. (05.03.080) H) Enforcement of Code (05.03.081) 1) Notwithstanding any other provision of this Bylaw, the Election Committee shall be responsible for upholding and enforcing this Section. BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 28(05.04.000) Section 4 – Regarding Employee Participation in the Associated Student Organization (05.04.010) A) Introduction (05.04.011) 1) The participation of all students at Palomar College is encouraged by the Associated Student Organization; however, the Board recognizes that some students serve additional functions in the campus community that may be perceived as presenting a conflict of interest, regardless of whether or not a true conflict exists. (05.04.012) 2) In particular, the participation of classified employees who are also qualified students as defined in the preceding sections, specifically Article V, Section 1, Subsection B (05.01.020), shall not be abridged in any manner or through any means other than that which is defined herein this section. (05.04.020) B) Limitations to Classified Participation (05.04.021) 1) Classified employees who carry a contract position defined as more than fifty (50) percent by the Human Resources Office [i.e. those classified employees who are employed by the College for twenty (20) or more hours per week], shall be held to the following conditions: (05.04.021[a]) a) Not more than three (3) such classified staff members as defined in Article V, Section B, Subsection 1 (05.04.021), above, shall be eligible for appointment to the Board as Senators through the appropriate channels and after having demonstrated the required eligibilities set forth in this Bylaw. Classified staff members shall not be permitted to hold a quorum majority of the ASO. (05.04.021[b]) b) Classified staff members as defined in Section 4, Subsection B, Number 1 (05.04.021) shall be required to submit to their respective supervisors a detailed listing of the requirements of Associated Student Organization participation, as outlined throughout these Bylaws, and shall secure written approval from such supervisor as necessary for BYLAWS ARE EFFECTIVE AS OF THE MOST RECENT REVISION LISTED ON THE FINAL PAGE OF EACH SECTION HEREIN , UNLESS OTHERWISE NOTED. BYLAWS ARTICLE V PAGE 29participation in shared governance. (05.04.021[c]) c) Classified staff members as defined in Article V, Section B, Subsection 1 (05.04.021), above shall be prohibited from holding the offices of President or Vice-President within the Associated Student Organization. (05.04.030) C) Other Classified Employees (05.04.031) 1) Classified employees who hold a position defined by Human Resources as being forty-nine (49) percent or less [that is, less than nineteen (19) hours per week] shall not be subject to the Bylaw criteria outlined in Subsection B, above (05.04.020 et seq.). (05.04.032) 2) Such classified employees are, however, advised that they should clear with their respective supervisors all requirements and commitments as defined throughout these Bylaws, and also should obtain the same written approval from their supervisors. (05.04.032[a]) a) Such approval, however, shall not be required by this Bylaw, and shall not be used to disqualify an otherwise qualified candidate for a position within the Associated Student Organization. (05.04.033) 3) Classified employees as defined in Article V, Section 4, Subsection C, Number 1 (05.04.031), above, shall not be prohibited from holding elective office. (05.04.040) D) Other Requirements (05.04.041) 1) Classified staff members of any sort shall be required to sign an affidavit concerning their comprehension of the necessity of separating their student status from their classified status; to wit, such members of the Associated Student Organization must affirm by their affidavit that they shall be acting solely as students in their capacity on the ASO Board and not as representatives of the Classified Unit or the Council of Classified Employees on any campus shared governance committee. (05.04.042) 2) The Appointment Committee for ASO Senators shall be advised that classified staff members may not hold a majority on the ASO Board, nor shall they be allowed to comprise a quorum solely of those members who are defined in this section. BYLAWS ARTICLE V PAGE 30(05.04.050) E) Retroactive Application of Bylaw (05.04.051) 1) The retroactive application of this Section of the Bylaws is strictly prohibited. (05.04.052) 2) Members who have served with distinction prior to the application of this Bylaw, and who would otherwise have their status changed by the application of such, shall not have their rights abridged or otherwise changed subsequent to the approval of this Bylaw. (05.04.053) 3) Members who have had their status changed by outside action or influence in anticipation of a Bylaw such as this shall be restored to their former position with all rights and privileges ascribed thereto; and to their prior title, if such title was eliminated from their position. (05.04.060) F) Enforcement of Code (05.04.061) 1) It shall be the sole responsibility of the Associated Student Organization in General Assembly to enforce this Bylaw. (05.05.000) Section 5 – Regarding Extraordinary Vacancies in Office (05.05.010) A) Line of Succession (05.05.011) 1) Should the office of President become vacant for any reason whatsoever, the Vice President shall assume the office of President immediately, with all the rights and privileges ascribed thereto, in accordance with the provisions of Article I, Section 2(B)(2) (01.02.032). (05.05.012) 2) Upon the succession of the Vice-President, a Senator shall be appointed to the office of Vice-President by the President, to be confirmed by a majority of the Senators in office at the time. (05.05.013) 3) Upon the succession of the Vice-President to the Presidency of the ASO, and the subsequent vacation of the office of the President before the scheduled election and conclusion of the term of office, should the office of Vice-President remain vacant due to lack of appointment or lack of confirmation by the Senate, a member shall be chosen by two-thirds (2/3) majority to succeed to the office of Acting President to complete the remainder of the term in question. (05.05.013[a]) a) If the term of office remaining is less than eight (8) calendar weeks, there shall be no cause for a special election to fill the Presidency by vote of the ASPC unless otherwise determined by the ASO Board by a two-thirds (2/3) majority.
